wow eventful school, mines a high school that our vice principal must think is pre school, even the most miniscule of swears (damn stupid crap etc.) she will suspend us for like 3 days for, its just retarted

Ok technically you cant punish someone for BEING a racist because of precedent. You can punish them for DOING something racist.

Also most people who are called racists may not be racists, they are just idiots (like what Yahtzee said about Capcom).

For the last few years of public school I attended, I never spoke the flag pledge. I did put my hand on my chest though that was just to avoid "what are doing?" or "what aren't you doing?" Someone getting in trouble for not doing that is stupid.
Standing up in the middle of a class and yelling, I can support a punishment for that, but I'm not sure expelling him is the best thing to do.
If he is a racist then I have a deep animosity toward him. But freedom of speech is more important than feelings.

He wasn't expelled for saying "cause that damn Obama" You said he was constantly a disruption, always getting in trouble, ect. Him disrupting class with a racists remark was just the final straw.
The administration finally came to their senses and expelled the spoiled brat is all.

This could have just been the straw that broke the camels back for all we know. From the op, it seems like he's caused a lot of trouble in the past, and this was at the very beginning of the discussion when he yelled it.

Even if this case did fall under freedom of speech, you must realize he was given the freedom to say what he said. The teacher didn't stop him. The point to be made is that his rights were not impeded, he just experienced the consequence of his actions. After all, even if you are expressing a right provided by the government, there are still consequences for what you do while expressing that right.

Against a public figure, he could say that Obama sold all the Jews to space aliens and get away with it if he could be qualified as believing it, since libel law is primarily extant to cover businesses and private individuals from being condemned at the court of public opinion for having enemies. There are huge amounts of case law and actual law governing provisos on public figures. It's probably listed in school policy in one way or another that disruptive acts are themselves actionable, but I've been in a class featuring a militant feminist accusing Bush of working with the Illuminati and the Bilderburg Group who got away without any sort of sanction. On the face of it, this appears to be a clear cut case of a disciplinary board with a God complex and (I hate to say it) fairly bog-standard left-leaning views. Problem kid, fine. Expelling him for a short outburst in class when political in nature? Not good. Even if justified, it makes the school look bad.
