I have Aspergers. I'm no world champion at being polite, try as I might, but Aspergers alone is no excuse for what this guy did. I say a prison sentence is the right thing - not only has he earned one, but it is a good, effective way of telling other trolls that their behavior is unacceptable.

I was wondering what you, fellow escapists, thought of this story.

Personally, while I agree with the consensus that posting offensive messages about dead teenagers is, of course, wrong, the fact that he was arrested for it is completely unreasonable.

It annoys me when people advocate free speech, but only as long as no-one gets offended.

That's why I say release this guy from prison, so someone can punch him in the stomach and let him get back to his life.
Umm people died. Free speech only goes so far as long as it doesn't hurt anyone. There is a difference between being offended and a teenage girl committing suicide because some asshole attacked her so viciously.

I say lock the ************ up.

OT: I am in agreement that it wasn't trolling, he was being a tool. His sentence is relatively small, let him serve it. Maybe he'll learn his lesson.

normally, i would say he should not be punished (other than being banned from facebook, perhaps) but seeing as he caused an attempted suicide, it means his trolling has become an actual threat.

The Westboro Baptist Church is in the US. This was in the UK. The WBC also, apparently, is quite aware of what the limitations of the US Constitution are and are abusing some loopholes.
Ah I see....Well just like the US would invade a country to get terrorists, the UK should come over here get those assholes. lol

Not really - The Malicious Communications Act 1988 banned sending people indecent/grossly offensive messages, including by electronic means so this has been illegal in the UK for decades, this wasn't a knee jerk reaction to terrorism. I'm a firm believer in freedom of speech, but there are a few exceptional circumstances where there should be restrictions (e.g. inciting people to violence etc). Even as a liberal/left leaning person I think if you send horrific and deliberately offensive messages to the families of dead teenages just for your own entertainment, isn't it reasonable to expect punishment for that?

There was a thread about this, i'm pretty sure it was an official one.

Either way, jail isn't really a fair sentence here. A fine, a restraining order, something of the like would have been appropriate here.

You realize the first amendment doesn't work like that right?

Fining him: pointless because he is unemployed

I personally like the punishment he received I read in a different article. The anti-social behavior order banning him from social networking sites for 5 years and having to inform the police should he buy a phone with Internet access. "If you arnt mature enough to talk online, we'll kick you out until you do mature" kinda ring.

OK. Aspie without Family support, so the 'reasoning' behind his actions may have been he had had it inflicted upon himself before, and that is considered the 'norm' or him. However, he was warned once, so a punishment is in order. And in terms of the 'Oh, dont we have freedom of Speech?' yesh, we do. But this isn't a freedom of speech issue. Its grounds for Harassment and invasion of private property (Although... the dedicated web page was on a social networking site, which makes the second factor Moot).

Personally, I think everyone involve (except for Duffy) has done the right thing. The distressed parents asking for something to be done instead of a vigilante style justice, Facebook for helping Police track him and the courts for actually dishing out a punishment. People will always say it was too harsh, But personal opinion i guess. Just don't use the same lame arguments.

This is a pretty messy case. I don't think anyone condones what the guy did, but every time you toss someone in jail for statements, not actions, that hurt only a very few people, you're moving a little bit closer to censure and police state. I think a fine would have been more appropriate.

We certainly do but our constitution protects the citizen, even after death, from unfounded allegations & defamation of character. It's part of the libel & slander laws, & works very much along the lines that an individual is innocent until proven guilty; The burden of proof is always on the claimant, not the defendant.

Slander & libel have been offences in England since before it was England. 130AD to be exact. I think you also need to re-examine the message Moore was making in V, especially considering his condemnation of the immunity from prosecution for libel that internet anonymity frequently gives.

Bear in mind that this article is in the Mail, a squalid deceitful rag of a tabloid which resorts to the seediest sensationalism to garner an audience. There has been no certification which supports Lance Whiteford, the defence's suggestion that the defendant was autistic or that he suffered from Asperger's syndrome. Indeed, Duffy specifically denied that.
