It wasn't temporary insanity. But it was definitely a "heat of the moment" murder. You're not supposed to give somebody a life sentence for something like that, so the ruling was still unjust. Even though he went into another room and grabbed a gun, I still feel it was "heat of the moment", because emotions can easily run high even for a prolonged period after a robbery takes place. He should have gotten 20 years at most. At most. But I heard the robber was black, and some are claiming the owner decided to "finish" the robber because the robber was black, not because he was a robber.

Why didn't he just punch the guy 5 times when he was down? Still inflicting a massive smackdown without the murder rap.

I may be jaded, but considering that I've shot at trespassers before on company property, I gotta throw my support behind the woman. You never know with some people. Heck, just earlier today I got an assault shotgun pointed at me..

he defended himself with one bullet,that completely incapacitated the robber.there was no longer a threat,he was bleeding on the fucking ground,not moving at all,and if there is no threat,guess what?YOU JUST MURDERED SOMEONE.

I could see pumping five rounds into the guy initially, I mean, you have to stop the threat, but going back for a different gun and shooting the downed guy more is a little much, even for me, and I'm a fan of making sure anyone who mightbe a threat to me is made damn sure not to be anymore.

I call bullshit. What does "heat of the moment" have to do with anything. Thats another name for crime of passion. Which most murders are. You do NOT get a pass because the situation was emotional. What happens next time tensions are running high?

In any case. Watch the video. It was after the robbery, he walks calmly up to the kid and shoots him 5 times, turns his back and walks away. He its not freaking out, or in fight or flight mode. It was a callous unfeeling decision he made and he deserves to sit in a hole for the rest of his life for it.

If the pharmacist really considered him a threat, he wouldn't have turned his back on him twice. Once while pursuing his accomplice, and again after stepping over his body to go get the other gun.

this seems open and shut to me.

You are right sir. Again, people this is in OKLAHOMA, if you have ever been there you would know how clear cut this case has to be for a jury to convict this man unanimously.

Definitely murder. If he'd shot him once and called the police it would be self-defense no question. But going back to make sure he's dead? five times? Cold blooded murder.

You are right sir. Again, people this is in OKLAHOMA, if you have ever been there you would know how clear cut this case has to be for a jury to convict this man unanimously.
I think it's pretty clear cut no matter where it is.

You don't think people should be punished for vigilantism? Because that's what this was. There's no way to say that getting another gun, coming back, and shooting an unconscious sixteen year old is anything but revenge killing.

Yeah, he lost the argument for self-defense when he grabbed the second gun and repeatedly shot a guy who had already lost consciousness. If he really was THAT uncertain about how incapacitated the robber was, he could have just... I don't know... Grabbed some large bandages (pharmacies have those, right?) and tied up his limbs... after calling 911 of course (and bandaging his head if he was feeling merciful).

If he had stopped at one shot it would have been fine. What he did was execute an unarmed individual who no longer posed a threat. People seem to forget that it is not self defense if you are not in immediate danger.

the retard kid got what he deserved, the pharmicist protected his business... fair enough. He on the other hand did not need to pump 5 more rounds if the kid is down for the count.

they both got what they deserved.

This guy deserves his life sentence, no-doubt. He already defended himself, he was not within his rights to shoot the person dead after he had already been removed as a threat.

Seeing as he was trying to rob the store, he deserved it. If some one was really trying to rob me, why should I let him live? He would probably do it again.
