Well mainly walking around town will get you screwed... maybe not in your backyard or the forest.
I was for 2 summers pretty active with softgun (bb guns??) and we got permision from our parents and used protective glases and the cops were okey with that as long as we were deep enough in the forest and paused the game if a jogger or someone else came passing by (which we did).
But my brother had an AK47 (it was a Marui(brand) so the weight and look was as a real AK and ones we biked to the beach from the "war", I only had a revolver so easily hidden in a bag) while his gun was a bit longer than the bag so the end was sticking out... The cops saw us and stopped us (we were 14 and 16 at the time) and gave us a pretty bad lesson and a harsh warning.

First off, I agree the guy in the video was being an obnoxious prick and the cop behaved almost perfectly. That said, I disagree with just about everything else you said. Open carry has it's place and I would hope that some day people will be able to open carry freely (and responsibly) without being harassed by the police every ten minutes.

Because he could only "add another tragedy to the list" if it were automatic? The capacity to commit murder isn't vastly different between fully automatic and semi-automatic rifles, which is why I think they should loosen restrictions on automatic weapons. Although I'm sure some of you will come to the opposite conclusion.

Why is it common sense to freak out at the sight of a "big gun"? Which I would like to add that a .22 caliber clone of an mp5 in no way counts as a big gun. That sounds more like hoplophobia than common sense to me.

I can see something similar happening here to be honest. There are regulations about how "toy guns" are supposed to have orange tips to show that they aren't real. I have an airsoft gun I got in High School that is modeled after the M9 Beretta. To most people (including myself) you could easily mistake it for the real thing. I looks real, feels real and has a really nice weight to it. The clip is made out of metal so you could easily fuck someone up with it. It does not have an orange tip so I never brought it around anywhere in public. I could have gotten in a lot of trouble if I ever had.

Depending on state law it is probably legal as it was in plain view. The gun clearly looks like a gun that could be fully automatic. I know in my state and several other most claims against illegal search and seizure carry no merit if the illegal item or the potentially illegal item were in plain view. I think the cop did a good job and the guy was quoting the wrong part of the law. I mean he got the right section but he would need to get state specifics on open carry or the specifics on if checking the gun is legally a seizure. I am unsure as I do not know where this happened or the states laws.

I have to wonder how many people walk down the street with open carry at all let alone some form of gun thatcould be an automatic gun at this location. I just wonder because here concealed carry is all the rage.

I think it's more "most people are perfectly reasonable people"; owning a weapon of any sort doesn't make you any different of a person. Characteristics and personality traits of people should supercede whatever weapon they own/carry in these instances, then things like this would cease (one would hope) to be sensational.

I think it is reasonable if an officer can inspect any kind of firearm carried around openly, it may be modified after all.

then again, I live in the Netherlands, and carrying a weapon around here will get the ME on your ass without a "can I see that thing ye got there, sir?".

yeah, we're pretty cautious about those.

I hate when people back talk cops. They aren't all jerk, seriously, the media just focuses on police brutaility because it give them an easy argument for nation wide law reform. There are cops that are genuinely good people who are just trying to improve the community.

Possibly. I guess we need more information before coming to a conclusion. Although under American law, simply being in possession of a firearm is not enough to warrant reasonable suspicion for any crime. Assuming the guy was simply walking down the street, this stop would be a 4th Amendment violation. But we don't really know what took place before the camera started rolling.

I only backtalk cops if they are being assholes. I am generally polite to any stranger I meet. Unfortunately I have met far more asshole cops than I have good ones, though the good ones I have met were pretty awesome guys.
