In reality, the child will be named in the lawsuit, but it will be the parents who pay for it. I don't have all the information, but the child, even at four, should know that hitting someone hurts and should of had enough time to stop or miss the elderly women (its not like the lady could just pop out of nowhere).
Should the child be punished, yes. She did something bad and someone got seriously hurt. Should someone be held responsible for the medical and other cost the elderly women suffered as a result of an injury imposed on her by someone else, yes!
