Oh honestly.

The blame game is a pathetic joke, and the US is the worst offender.

When you refuse to take any collective responsibility for the welfare of others, of course you're going to end up with people 'suing' each-other constantly.

With no recourse to any collective help for accidents, the only viable option is to try and pin the blame on someone specific, and basically drag both of you down.

Even if the 'blame' lies with a 4 year old.

Sick.

But a natural side effect it seems of a culture that takes personal responsibility and puts it on a pedestal above any sense of group responsibility.

Because, if you, and you alone are responsible for your good fortune, then clearly, if something bad happens you look for a specific person to blame for it as well.
Damn the consequences.

Obviously fucking not. Do you even need to ask?

This whole thing is almost as absurd at the McD's coffee incident.

Good gravy.

I think someone just deserved the paper "You are a complete idiot, and shall be devoured by Pinky." award. Seriously, what kind of idiot...?

One. negligance?!

Two. Who the fuck would sue a four year old. In most cases cops wont even arrest a four year old

Three. The prossecution would/should be on the parents as legal guardians, but then there's no way the charges will stick

In Canada, you watch TV.

In America, you sue TV!
In alternate universe of Soviet America, 4 years old and TV sues you!

OT:that girl shouldn't be sued, mild punishment and warning should be enough, beside,it's not like that old lady is seriously injured or dead, otherwise, the parent should have been sued instead.

Why are they suing for the accident 3 months after it? It even said she died from Unrelated causes, so how could the kids be held reliable?

Did anyone else notice the part of the article that said she died of unrelated causes? So are they suing over her death which was unrelated or for her getting hit?

It's not even negligence! It was kids riding their bikes, and they had an accident. Shit happens. I hate to sound insensitive, but maybe the old lady should have been more watchful. Especially if her estate is so quick to sue a child.

This shouldn't even be an issue, I'm disgusted that this is the type of bullshit that courts have to handle. Please, people: pull your heads out of your asses and stop going to the courts expecting the judge to hold your hand and fill your sippy-cup.

wow just....wow. There is a special place reserved in hell for the involved laywers.
No, there's a special place in hell for the prosecutors. Lawyers are (normally) good guys; they defend people. They are the guys you should be cheering for.

You. lawyers that will work on this case. Go die. Violently.
That means you too.

Anyway, while I think the mother should be able to be sued for negligence, the child should not. For God's sake, the age of reason is 7! At minimum!

To paraphrase a republican pundit: "You can sue a turtle in this country if you want to."
