You can sue parents of 4 year olds.
The old lady got hurt by the kid.
One could argue the kid was not being properly watched.

Talk about "letter of the law..."

This is even more depressing because the guys doing the suing are the "estate," not the lady herself (sadly dead now). There is literally nothing behind this case aside from moneygrubbing greed.

lmao xD Currently studying Tort law and I know precisely what you mean. I also agree with you, American law is the most claimant friendly law there is and their bounds of negligence consistently encourage the ever present blame culture found in american society.

Haha, but the whole idea of a Generalised Principle for tort was in itself revolutionary to negligence law. Fair enough it was very open to interpretation and vague, but i'd rather blame the following case law for the stretching of negligence.

Maybe old people should look where they're going. I can't imagine the 4 year olds were racing their bikes at 50km/h down the road.

it wont matter, as she has, what? no personal belongings (that she bought) whatsoever?
and this may sound cruel, but the laws of Keep-your-species-existing should make a minor more important than a senior.
besides, "The Judicial system being cruel/unfair" is not really big news anymore.

That's nice, but it's still (by his own admission) speculation, and in the meanwhile this sets a rather dangerous precedent. So I'm not sure that's the best defense here.

it is my opinion that you should not sue the child but the parent. i mean if you get hit by a bat you don't sue the bat you sue the dude hitting you with it.
