Isn't it technically illegal to ride your bike on a pavement?

If 4 year old children are legally culpable for doing this, then they may have to start riding on the roads with the cars, despite that fact they'll be all but invisible to the traffic.

Also, if 4 year old children can be sued for the adult crimes they commit, then what about the little children at the beach who run around naked? Can they be sued for indecent exposure?

I hope the four year old gets to be tried by a jury of it's peers in court, that would be adorable.

If that's the case then they shouldn't be able to ride bikes at all. I they ride their bikes on roads they are so EASILY going to be hit by someone who either isn't paying attention to what is in front of them on the road or can't see beyond them.

In either case, it's still crazy to sue a four-year-old for something like that.

No, I don't think so. That should be up to their parents to keep under control. Children shouldn't be running around naked unless it's one of those beaches that allows it. But even then, I think that's only adults, so my point still stands.

Suing a child for something like that? Anyone could have done it. It was nothing more than an accident.

Sure, the woman was hurt badly but that doesn't make it the children's fault. It isn't like it's the kids' fault she died.

Okay, in order to beat this dead horse a little more i feel there are things that need to be said:
1) the article in question contains 2 errors, that it was 3 WEEKS not months, and the death was unrelated to the surgery not the crash (meaning the hospital didn't screw up).
2) YOU CANT SUE THE PARENTS! by law you have to sue the child, the parents insurance will be the one liable for any financial damages.
3)they are suing to recoup the losses due to hospitalization and funeral expenses, no pain and suffering. a court will decide who is responsible.
i dont see anything here as over the top ridiculous as people are making this out to be.
