First off, this is just plain silly. Clearly the mother of the bully is trying to dodge charges against her son for assaulting his classmates by trumping up charges of her own against her sons victims, which is a despicable manipulation of the legal system.

Second, and more importantly, I hope the driver of that bus got fired. I mean, Jesus H. Christ, if a fight has escalated to the point that people are being strangled and crotch punched, it is time to pull the damn bus over and intervene!

Usually a sexual assault occurs when someone touches any part of another person's body in a sexual way, even through clothes, without that person's consent. Some types of sexual acts which fall under the category of sexual assault include forced sexual intercourse (rape), sodomy (oral or anal sexual acts), child molestation, incest, fondling and attempted rape. Sexual assault in any form is often a devastating crime. Assailants can be strangers, acquaintances, friends, or family members. Assailants commit sexual assault by way of violence, threats, coercion, manipulation, pressure or tricks. Whatever the circumstances, no one asks or deserves to be sexually assaulted.

I think we can safely assume the bully did not want to want to be punched int he balls. So yes, it is.

HOWEVER, if he gets charged with sexual assault, i hope that bully gets charged with attempted murder, theft, and just regular assault for choking the kid and stealing hsi gloves.

Being choked probably had something to do with that, too. I know if I were being choked I'd get in whatever punches I can, cheap or not. Seriously, what sort of sad world has this become when the victims of bullying are being punished more than the bullies themselves? Or people defending themselves in general? Surely he won't get convicted.

What is wrong with society and protecting bullies? Bullies are not the victim. Perhaps bullies are victims of another problem, but not in this situation.

That kid punched me in the balls. All I was doing was taking his stuff, calling him names and choking him half to death. I didn't do anything wrong. Why would he do that?

seriously kid, if you're going to bully someone then man up. Goddamnit, even the bullies are wusses these days.

I was kicked in the nuts in school once teachers just told me to not be soft.

Where I come from in Norway we have a word for this... It roughly translates into "take me from behind in a tub of lard", but means "this is stupid"... And this IS stupid. If someone seriously suggested to me that this is the right thing to do, I'd likely be charged with sexual assault myself, and I'd have the exact same lack of sexual motivation as this 7-year-old... Yet to meet a sexually active 7-year-old too, so...

I'd like to point out that he probably kicked him in the balls.

Also, even if he did punch him, that still wouldn't count, because it wasn't sexual in nature. If anything, he would be charged with assault, not sexual assault. Unless punching someone is now considered to be fondling.
I wouldnt be surprised, is about all im trying to say. if he kicked him, you could say he just has a foot fetish.

Do seven year olds even know what sexual harassment is? Because I sure as hell didn't know what it was when I was seven. In any case people will see how dumb this is and come to their senses... I hope.

Generally no. I'm assuming the other kid's parents might be after money or something.

How do they plan on punishing the child?
Put him in therapy to not make him a sex offender? List him as a sexual predator for life? Put him in Juvi? I'm pretty sure all of those experiences would scar him.

i got in so many fights growing up, it was part of growing up. All the way until high school and it only stopped then because we moved out of state to nicer higher class neighborhoods. But in those early neighborhoods, everyone would have been deep trouble by these standards, everyone. hehe

Usually when younger kids get charged/sued for something it's the parents that take full blame. They can't sentence him to jail, and they can't fine him, but they can fine his parents.
