I think we can safely assume the bully did not want to want to be punched int he balls. So yes, it is.

There have been so MANY of equally stupid incidents like this in the past few months. Just to name a few(paraphrased):

"Child brings a squirt gun to school -- gets prosecuted"

"Student gets hit during a game of dodge-ball(no injury whatsoever) -- but parents still sue the school for a ridiculous amount"

"Teen is charged with murder attempt after 'impersonating' an assassin at a High School Halloween Party"

If the bully was choking the kid, then I say that the kid has the right to defend himself. Isn't it even taught in some self-defense classes to go for the crotch if you are attacked?

Every school I went to so far, is making it out that fighting back is against the rules, so your going to get seriously punished for simply pushing the other kid away. And its seems to be national, "Yes, Billy tried to choke me, so I kicked him in the balls." 'Alright, Tom, 12 years of juvie for you. 9 Years for Billy.'
