I think a 7yr old child lacks the "intention" required for sexual harassment (assault?), which means that legally, he is incapable of such a thing. He's just a smart kid who knew it would be painful for the other kid if he punched him there.

Rules are good, as guidelines. But when you attempt to take them literally and apply them to every situation without looking at the circumstances, you get idiotic moments like this.

My god if they think a nut shot is sexual assault my entire highschool ( i graduated a few years ago) would be in jail by this point, this is so stupid.......I REALLY don't want to live on this planet anymore

Im not even sure what to make of this, Sexual Assault? For testicular manslaughter?

WAIT! than that means if anybody hits me in the nuts, including women, I can go after them for sexually assaulting them?

It would be a bad thing for this kid to be successfully charged with sexual assault. Not simply because it isn't sexual assault, and not because he was standing up for himself against a bully, but because of the precedent it sets.

Having any part of your body purposefully connect with the private regions of someone else for any reason, regardless of circumstance, is now considered sexual assault? Well, I guess women who defend themselves against rapists by hitting the guy in the junk are now guilty of sexually assaulting their attempted rapist. Send 'em to jail.

Agreed. If they see the boy punching the others crotch as an act of sexual assault, then they have to see the other boys attempt at strangling and stealing the gloves as reasons to charge him for thievery and murder.

Punching someone in the crotch isn't okay and i understand the whole "keep your hands to yourself" rule, but he was being bullied, so of course he retaliated, and FYI punching someone in the nuts ISN'T SEXUAL ASSAULT! RAPING SOMEONE is sexual assault!

Despite what some people might have you think, schools actually aren't legal authorities in the U.S., so they aren't levying any criminal charges at all. They're investigating the possibility that this might fall under the purview of their sexual harassment codes. He faces school suspention or transferring.

Like I said, more information is needed to pass judgement.

I don't really care what happens if all he's facing is school based punishments. School punishments are trivial. The only time (at least in Australia) that school punishments really matter are when they affect your grades for year 11 and 12 (suspension during exam time or on a day when an assignment is due, expulsion which leads to you taking a new/different class you've missed a few terms in so your grades suffer while you play catch up, et cetera) because it affects university entrance.

If they can charge a 7 year old, why haven't they charged the 10 year old for drowning her little brother?

This is just plain stupid. The kids seven years old, for crying out loud! It was self defense. Of course, in this day and age, self defense seems to be strongly frowned upon. If this is know sexual assault, then both my brothers and I have been guilty of it at some point in our lives. I just..don't even... Gaaahh! People!!

I'm fairly certain that a punch to the gonads isn't really a sexual act unless you happen to be into some kind of weird, kinky S&M stuff.

To me the fact that this was labelled sexual assault rather than regular assault says more about the person who made the claim than it does about the seven year old being charged.
