Oh jeez really? Well from what I can get out of it the gnome itself is anti-nazi in the way that its just too comical to be taken seriously. On the subject of the city banning Nazi gestures and stuff, cmon, it's part of your history, albeit not the proudest moment but part of it nonetheless, no reason to deny it happened. Personally I have no inclination towards or against Nazis, though I do find Adolf to be a fascinating individual for the way that his mind worked, pity he didn't use it for good...

To me, it's coming off like a post modern artist trying his hardest to make something edgy that the art world would notice. I mean, this is obviously my assumption and it's entirely possible that there's some sort of genuinely profound point behind it. So far I haven't found it.
With that said, it is no one's place to censor art save for the artist himself (in my oh so humble opinion).

A few years back, some idiots actually tried to punish people who created posters/t-shirts/pins with images such as this:

Of course, this was properly evaluated back then, too, and any use of the swastika in this or a similar fashion is obviously still legal.
However, it was a quite scary to see some people go totally bonkers over something that's clearly antifa.
Luckily, our courts aren't that stupid. I love separation of powers, let me tell you.
EDIT: Wow, totally forgot to answer the OP. Yeah, if you can't tell from what I wrote already, I think that this gnome is obviously making fun of Nazis. I mean, seriously, the "glorious armies of the third reich" probably didn't see themselves as lawn gnomes.
I'm sorry, this can be identified as satire from the distance of three hundred miles. So, frankly, I'd say this is another case of authority saying "well, we'll run through the procedures, and we'll see" and then the media finding out and leaping upon said authority in attempt to mount it.

It is the Roman salute that was taken by mussolini and his fascists then copied by hitler and the Nazis'. Doing that salute does not make someone a nazi.
Anyway, i think its obviously anti nazi. Its a GNOME. You can hardly expect a gnome to be an endorsment of nazi-ism
