I'm not a lawyer. Both my parents are, which is why I know a little about basic theoretical concepts. However, most of my knowledge about this comes from campaigning and being around policy researchers who are more knowledgeable than me about this specific area.

I'm not claiming to know a huge amount. This isn't my subject, and I'm not going to argue with a more informed opinion when I'm just parroting smarter people than me (and almost certainly dumbing down their thoughts in the process). However, I know enough to know that the basic premise of this thread (that courts sit around debating consent in a highly abstract fashion) simply isn't right.
