As for the idea to sell games with betas of better games to increase sales and raise awareness of the better game: It has been done before Crackdown/ Halo 3 so there's hardly any point in arguing.

Now for the whole 'ripping off' ideas from a competitor: Where have you been living? It happens all the time and is done by everyone. Microsoft pretty much took the avatar idea from Nintendo without bloody changing it. 100% rip-off. You know what? No one cares, it's buisness.

And to mention jumping on the whole motion senor band wagon aleast 360's (This only rumoured)Doens't look complety like a re hash of the wii come on sony the wii controller ben at the top with small hand guard load'a ball shit!(just google it)

'Ripping off' is an incredibly lazy way of describing the process by which progress is made. In every single field, be it engineering, electronics, science, whatever, almost everything is a 'rip-off' of what came before. Good ideas survive and the bad die, while the good ideas are taken a step further. Microsoft have ripped off the OSX toolbar to make the frankly excellent Aero Peek toolbar, Sony ripped off the N64's analogue stick to make a now-iconic controller design, everyone is ripping off the iPhone after realizing how staggeringly useful it is, hopefully MS will rip off Sony in regards to the quietness and reliability of their hardware.

Hell, even Darwin was working off the back of other peoples' findings his entire life, and almost didn't publish Origin of Species because he was afraid he was stealing the limelight from another, very similar piece of work. This is how life and progress works, even if it does get a bit cynical and lazy at times.
