Oh fuck no, if justice actually failed me, and I knew for a fact he was guilty, I would see him dead. Whether by my hand or anothers, I would try very hard. Realistically, I think murder, the only thing you really have no chance to recuperate from.
As for you question.... it all depends on the circumstance. If your talking about being in the moment, and watching my family be murdered right in front of me, then yes, I would kill him. If it was down the road and he was captured by the authorities and going through the legal system, no, I would let Due Process take it's course.
Rape would be my #1 sin. There is no justification of it.
