In the wake of the September eleventh attacks, the Bush administration scrambled to develop a network to locate, capture, and interrogate members of Al Qaeda. President Bush authorized the use of ?enhanced interrogation techniques? to obtain valuable information from detainees. We are now seeing the effects of this harsh decision. The methods of torture used by the CIA do nothing but harm the United States? safety and reputation. While these ?enhanced techniques? maybe be effective at eliciting a confession, they rarely lead to a conviction. There are also cases in which detainees who are tortured are eventually found innocent and released. The CIA?s heavy handed tactics not only harm innocent people, but sabotage the justice system that should be sentencing guilty war criminals to a rightful punishment.

CIA officials should not be shocked to see that tortured prisoners are not being considered completely reliable. Abu Zubaydah, a close associate of Osama Bin Laden and the main recruiter for Al Qaeda, was captured and interrogated in April 2002. Zubaydah revealed valuable information before being transferred to a black site in Thailand. It was here that Zubaydah was subjected to repeated water boarding. FBI officials expressed doubts about the torture, stating that FBI agents were able to extract information from Zubaydah without force. They also expressed concern that the use of such invasive methods would both affect the Nation?s standing and jeopardize future convictions. Even some individuals within the CIA itself questioned the tactics employed. The early warning signs were evident and should have been headed.

The experiences of Binyam Mohamed perfectly illustrate both of the negatives caused by CIA torture techniques. Charlie Savage writes in his article ?Court Dismisses a Case Asserting Torture by C.I.A.? that Mohamed claims to have been tortured by the CIA in both Morocco and Afghanistan before being transferred to Guantanamo for five years. While abroad, Mohamed was subjected to numerous tortures including genital mutilation. He was released to Britain in 2009 and filed his own suit against the CIA for the pain inflected upon himself. That case was thrown out due to the dangers posed by exposing CIA secrets to the public.

The unsigned editorial ?Legacy of Torture? reveals more about Binyam Mohamed?s story. During his imprisonment, Mohamed provided evidence against another prisoner, Farhi Saeed bin Mohammed. Farhi is a suspected Al Qaeda fighter, and Binyam?s testimony was the final piece of evidence needed to convict him. However, Farhi?s case was thrown out because the testimony obtained by Binyam Mohamed was not reliable because of the torture he endured. Even when the CIA gathers new confessions from prisoners, most judges will not accept them because the testimony is already stained with the detainee?s past experiences of torture.


The CIA was able to simultaneously tarnish the United States? reputation and put a stop to a known terrorist?s trial. The Bush administration?s aggressive foreign policies may have seemed appropriate after the emotional attacks on September eleventh, but those decisions are now blowing up in prosecutors?? faces. It is obvious that new methods must be found to extract information from prisoners. Torture may produce confessions, but it does not help the situation in court. President Obama has condemned the use of torture on suspected terrorists at Guantanamo Bay and other international sites.

When the United States uses torture to glean intelligence from captured men and women (terrorists or not) the country stoops down to the level of the same factions we claim to be fighting. Torture is not a viable means to stop terrorism, the courts have proved that. The United States acts more like the monster Islamic fundamentalists claim it to be by using such barbaric tactics. The Bush administration?s policies are out of date and out of line and only serve to weaken the country they were meant to protect.
