This is a clear violation of freedom of speech and freedom of the press. She got arrested for something which she said on Facebook, that is a clear violation of her rights.
I don't know where you live, but where I am freedom of speech does not cover fighting words or death threats.

Bullies are by their nature cowards, in school and society. The evil, odious effects of being bullied stay with you for life ... On this day you did an act of gratuitous nastiness to satisfy your own twisted nature."

Niiiice. I love the way the judge ripped into her as she deserved. Now all we need to do is make trolling an imprisonable offence as well.

You grossly misunderstand how these rights apply in daily life.

Firstly, I'm going to knock "freedom of the press" right in the head; the accused had no press affiliation, was not working for any accredited news source, and was not reporting on a story at the time. It just doesn't apply. At all.

Secondly, as mentioned many times by many others, "freedom of speech" doesn't extend to making death threats or threats to inflict harm on someone else. Especially if you have a track record of fulfilling those threats, and have the means to carry them out... but even if you don't mean it, calling up someone on the phone and making threatening statements is indeed a crime.

So no, the accused's rights were not violated by this judgement. She now has some time in a correctional facility to find a better way to manage her childish outbursts, and hopefully a life while she's at it.

So they put a girl in a pseudo-jail for drunkenly typing, but they let off the guy who broke my nose and jaw with a warning?

Life is fair.

Things like this have a habit of backfiring...

It wont be long before people are sent to jail for making Xbox's owners feel "inferior" on forums.

How long before being a fan-boy becomes a criminal offense? Will this judge still seem "Awesome" when Sony is forced to lower the quality of their product so that microsoft fans don't feel prejudiced against?

LOL stop the insanity!

i don't know because i don't use facebook but isn't there a way to block messages from people... it seems like the ability to block/ignore people would help the problem with "cyber bullying". to be honest i laughed a little bit... now i feel bad.

"Since Emily Moore was 14 you have waged compelling threats and violent abuse towards her ... Bullies are by their nature cowards, in school and society. The evil, odious effects of being bullied stay with you for life ... On this day you did an act of gratuitous nastiness to satisfy your own twisted nature."

I can't stop smiling.

I met enough of these people in high school, and watching one of them go to the slammer for this crap is absolutely heart-warming.

The manner in which the judge described it though is the real clincher. To have those words available to describe the both infantile and nefarious nature of bullies is beautiful!

In the words of a great many posts from the 'Unskippable: Xblades' review...

Yay lion!

Good, she deserves every bit of that punishment. I'm just surprised she didn't get arrested earlier, seeing as she'd already had two offenses prior to this one.

OH, I hope this trend carries to the U.S.
But then we'd have to arrest everyone on 4Cha..........[small]actually, I'm all for it now[/small]..........
Exactly what IS ther to do on 4chan anyways? I visited once and all I found were some wierd GIFs, trolls, unappealing pornographic images, and a bunch of people saying "sauce".

wow!
This place has really got great misleading titles. Just like real newspapers! :p

the person had history of bullying a certain victim. If she had just did this through the internet and not as well in person contact then this would be a first.
