Does not the topic devolve into asking if one group should abide by the rules of war when attacking by a superior one?

If humanity does not have to abide by any of the rules of war when attacked by technological superior aliens, than, say, it's fine to torture captured US soldiers under the same logic?

The Geneva Convention came into existence in 1864 and was made up of 4 separate treaties, the 1929 convention protected the rights and treatment of POWs, the post war convention in 1946 added the treatment of civilians during war to its rules.
