A part of copyright law that states the customer/ consumer has the right to do anything they want to there own copies of media including, selling, destroying or even copying of said media.
Assuming there's still a disc format, they could still sell the disc with the content on, it just would be unuseable? Just like PC games.

I don't know the situation elsewhere in the world but PC games are about £10 cheaper when released in UK compared to the same console version so they might drop in price? If it can be done on the PC, then I can't see any reason why it can't be done on the Xbox 3.
If it's true, it'll be interesting to see if Sony follows suit on the PS4. If it doesn't, I can see Xbox 3 gaining a lot more exclusives next generation because publishers won't want to compete with the used game market on the PS4 and will just make more profit (theoretically) by releasing on the Xbox 2. Of course that only works if people buy the Xbox 3, which people will do to get the exclusive titles?
