Anyways if this was a real issue the Whole capitalized V thing would be a problem because it would make it look like DC was trying to cash in on Zynga... though as said before... they don't really need too.

F that. DC should counter-sue, since they had copyrights to Smallville long before Zynga existed. Since Zynga claim everything "ville" is so easily confused, their entire "ville" catalog infringes on DC's copyrights and trademarks, not the other way around.

Suck on Consider that, Zynga.

PS: Yes I did see the source. Doesn't make this a bad idea.

Wait, what?? Why is DC making a browser game, why not just change it to Smallville and how did Zynga trademark 'Ville'?
That said, I'm actually torn on this one. I hate Zynga games as much as the next guy, but that capitalized V does seem a bit insinuating. However, Smallville has been a DC property for decades and all they're doing is capitalizing a letter, perhaps to avoid confusion with the TV series.
The general feeling I get from this is: It's a waste of the courts' time.
EDIT: Good one. My point still stands, waste of time :p

I can't see how DC could possibly win this case.

Smallville is how people recognize your show and associate it with Superman and DC.

SmallVille would never have been made without the popularity of Zynga title's to steal from. They have no other reason to have modified their title.

After DC loses this court case, I hope they release the game as 'SmaLlvillE'. So they can justify that their intent was just to modify the look of the name but not steal from another organization.

It can cause confusion with Zynga's IPs? Well maybe if EVERY SINGLE ONE of your games didn't end IN THE SAME BLOODY WORD, you wouldn't have this problem!

Wait is Zynga trying to sue because DC are using a upper case 'V' instead of a lower case one? Can you actually hold a copyright on a capital letter? I sure hope Zynga get laugh out of court on this one or Sesame Street is screwed.

So Zynga's idea of originally and innovation is to make the same game twenty times with the same grammatical error in the title. I wonder if they have any position open, I've got some original and innovative ideas that will blow their minds :p

I agree. The increase in the lawsuits and copyright of major words is getting out of control!

No one owns the word Ville or Scrolls (Bethisda bs...). DC has pulled bs like this before, but I will defend them just like any other.

My god, Zynga must have a death wish, that, or it's populated with people who have been designing and researching "Innovative and original games" (They wish) under a very large stone. Mostly because they can't seem to remember the very prevalent pre-Zynga existence of Smallville. I can forgive them for not knowing Superman's backstory, but ignoring 10 years and 10 seasons of the extremely popular Smallville series is idiocy.
EDIT: Oh for fuck's sake, I fell for this? Damn.

Actually, due to my previous work in the computer business sector, I DO sit down and read through every EULA now. Twice.
It's not pleasant sifting through legalese and jargon scientifically designed to bore you, but it's becoming increasingly necessary. More courts are starting to accept them as enforceable.

great post, and highly agree, this is absolutely mind boggling on so many levels, not even the actual trail side of it, the mere fact that zynga thinks they develop original and interesting games...that deserves a laugh upon itself, to top it off the absolute cunty move of trying to sue over the use of "smallville".

I seem to remember a show called smallville that existed long before farmville came out.

Also, this Capital V stuff sounds suspiciously the same as the people who try to avoid taxes by claiming mail addressed to them in capital letters is not actually addressed to them.

Okay, first, lets get it out of the way: Zynga steals games, and then copy-pastes them multiple times to try to increase their customer base. The are a terrible games company that only exists by virtue of how powerful social games can be as a business, and any old turd would have done just as well in Zyngas games place. I also laughed when Zynga said that they make innovative games and are upset by the idea of people stealing there ideas. They are douchbags.

...but actually read there complaints and you have to admit that even a broken clock is right twice a day. They arn't complaining about, "Smallville". They are complaining about "SmallVille". They are complaining about DC using an arbitrary, pointless capitalization whose only purpose could be mimicking Zyngas naming convention. And they arn't demanding a different name, they are demanding that they drop the capitalization.
