Since she was drunk I'm not inclined to think she was raped. She was probably just tanked and thought it was a good idea at the time. Two people at my school were accused of rape because the girl was drunk and just regretted it, so it happens.

Yes actually, he does, it is his legal right just as much as it is hers.

And if you wake up in bed with an under aged girl that you don't remember, you should not have drank nearly that much. I completely disagree with that, the only reason you never hear of cases like that is because it is less common for males to be in that position as opposed to females, and if they are, they are also much less likely to report it.

"Rape" can be a misleading term, too, and statistics involving it can be inflated. In the state of Indiana, for example, if one or both parties of a sexual duo are intoxicated, even if consenting (even if boyfriend and girlfriend in a long relationship!), the unintoxicated party (or both parties, if both are drunk) is considered a rapist. By this (ridiculous) rationale, I am a rapist, as is my girlfriend, and many, many people that I know.

Could be worse.... Could have a house party... invite about 100 random people as well as your 50 friends, have over 250 people show up and DESTROY the house, causing over 50grand worth of damage(Windows smashed, kitchen appliances ripped apart, Hottub filled with cement, car stolen, furniture burnt etc, etc), which in turn causes your family to move out of the house because it is unlivable, and send you away to live with your aunt and uncle(away from parents).

Thats my new logic whenever anything bad happens.

If she doesn't remember consenting to this person then you can only take her word for it. And people forget a lot of important things while under the influence, which is why it's just plain idiocy to sleep with someone you don't know while on the piss. She may have consented and she may not have, but if she did then there's a good chance she doesn't remember doing...and she's 16 too which makes it worse for the guy.
