Let's be fair now, an identifying characteristic of Asperger's Syndrome is the incapacity to make the connection between behavior and consequence. He may not have known he was pushing the line, especially if he was smart enough to know how to do what he did, he probably would've been otherwise smart enough to know he was risking his neck without his mental handicap.

At first I thought UK was sending us their trash, but in this case, the US should be the decider, since it affected the US, not the UK. If a US citizen did the same to your government, I would be for sending them to suffer under your laws. If someone wronged you, would you prefer to decide how to make ammends, or leave it to their parent (since it is easier to relate with kids with parents) who may not do it as severe as they deserve since it is not really their problem and may not think it so bad.

Now that is just for any case. As for the actual person, I do not think he should be put in jail, but should not be just let go. If the UK will follow through on the US's sentencing, then he can stay in his own country for it too.

He shouldn't have to; but sadly, America does have the power to do this. This was formed in an agreement signed by David Blunket a few years ago stating that America can take people from Britain to America without any evidence whatsoever. It's not right but they have the power to do it.

Also, I don't think he should be punished based on himself being autistic (partly because I am autistic my self), but is that the actual reason for them having a different punishment? Or would it still be the same if the suspect has no mental-differentiations to the rest of society.

Well, this is going to sound like a conspiracy theory, but I think the US wants him sent here so we can sentence him to jail, take him off the grid, and turn him into one of our counter-hackers and expose security flaws.

In truth, though, I would want him sent here, but on the promise that he would receive a much less harsh sentence and minimum security, white-collar prison/mental help. Technically, I think, this is an international crime, and as such international laws must be used.

nope while he was in the UK at the time the servers he accessed were located in the US. there is many a court case that have proven you must be tried in the country where the servers are located.

the crime is committed where the computers that are accessed are located, not where the personally physically is.

i do believe there are also cases where people have been extradited to the UK from the US for hacking computers in the UK.

No kidding, I wholeheartedly agree with these statements. Besides, who is to say he's really looking at aliens? He could be like a kid saying he didn't do, or saying his sister did it, could very well be an excuse to avoid trouble. I wouldn't doubt that too much, give him the fair trial though, it was a problem in the US, it should be handled in the US.

He didn't commit the crime against the UK, he committed it against the US, so it's America's ball - not Britain's. He might be their citizen, but he hacked our shit. Laws are different from nation to nation, and international incidents - which this as a technicality is - has it's own set of rules, and since he isn't a government ambassador with immunity, his crime should be punished by the laws of the society he committed it against.

As to whether or not he should be punished because he's autistic - What happened to equal rights? If employers have to hire mentally retarded people the same as they would regular people and do their best to treat them the same, then they can be punished the same. Equal rights. 's a ***** when you get in trouble, isn't it?

As a person with with Asbergers I am insulted by the term "mentally underdeveloped"
I believe that this is a deeply complex issue with many layers of consequences

for starters, I do not believe that the fact that he has asbergers syndrome should factor into his sentence, it seems unfair for someone to be judged differently for the sake of a label

all men are equal in the eyes of the law

secondly this scandal could have massive reprecutions for the "Special Relationship" that Britain has with the United States

Thirdly, he broke AMERICAN law, not british, as such it would be a fallacy to prosecute him in a crown court and a massive drain on resources (when the immense complexity of the case is considered, the resulting legal battle would cost tens of millions of pounds out of the taxpayers pocket, it is interesting to note that a large percentage of anti-extraditioners are of the upper-middle class persuasion)

Thats what I think as a British person with Asbergers

Probably was just bored, however, considering he got into NASA on a whim, I wouldnt be inclined to let someone with that kind of power just mince around cyberspace.
