This incident happened several weeks ago in Philadelphia to Mark Fiorino, a 25-year-old IT worker who carries a gun on his hip at all times for self defense. He got the gun after several friends were mugged.
But he didn't count on attacks by police:
On a mild February afternoon, Fiorino, 25, decided to walk to an AutoZone on Frankford Avenue in Northeast Philly with the .40-caliber Glock he legally owns holstered in plain view on his left hip. His stroll ended when someone called out from behind: "Yo, Junior, what are you doing?"
Fiorino wheeled and saw Sgt. Michael Dougherty aiming a handgun at him.
What happened next would be hard to believe, except that Fiorino audio-recorded all of it: a tense, profanity-laced, 40-minute encounter with cops who told him that what he was doing - openly carrying a gun on the city's streets - was against the law.

Amazing how the police can damn near shoot you when you try to be the reasonable one.

I don't know anything about the gun laws in the states but shouldn't it atleast be concealed?

There's been a lot of incidents lately with cops who clearly don't know the law very nastily apprehending citizens who are not causing any trouble. My previous employer got arrested for protesting a city curfew in front of city hall in Greenville. It was absolutely insane.

He had a carry license? Or a concealed carry license? Makes a huge difference. I don't know PA laws or anything, but if he's not allowed to carry it in view, then he's not allowed to carry it in view.

However, if he has a carry license, this cop should be out on his ass immediately.

No, you need a permit for concealed carry. Carrying a gun openly is perfectly legal AFAIK.

As you can see, you don't need a license to carry in Pennsylvania.

Depends on your state, though, lots of jurisdiction like having all sorts of weird and wonderful laws for the police to abuse.

EDIT: You beat me to the relevant bit though.

Yes, and if you look at the map, you'll note that PA is orange, meaning you don't need a license to carry a gun openly.

Though you could argue about being reasonable by carrying a firearm at all times...

But I don't wanna bring up the old gun-crazy American stereotype again so please don't take it the wrong way.

I am not surprised by this, and I reckon the cops in question will get off scott free.
As they always seem to do over there.

The police in the US seem like they are above the law, and can nearly do as they damn well please with little to no punishment.

It's disgusting to see in a modern, secular state.

I don't know about different states, but here in Kentucky, your free and clear to carry a gun so long as it's visible. You need a permit to conceal carry. You got to take a class and be certified. My Dad has a conceal carry permit. I'm not much for guns myself. But even with a permit or a visiable weapon, there are places you just can't bring them. And you can't cross state lines with a kentucky only conceal permit.

Basically, if this guy was walking around here like that, he'd be perfectly legal. I don't know bout philly thouhg. City may have an ordierence or law or somesuch we don't have down here. *shrug*

I have had numerous incidents around and in Reading, PA, with this very thing. this only turned ugly once, and after about twelve attempts to reason with this dumbass, I said fuck it and and blew his kneecap off. That was the only time I have ever lost my temper... IN MY LIFE!!!
I always have however preferred to carry concealed, takes the tension(or stupid) out of people.

We open carry for self defense, it is perfectly reasonable to want to keep yourself alive.
Weird, I've never had the need for a gun to keep myself alive... Must be a lot of psychos over there.

Oh well, to each his own. If you have the right to carry a gun, you can carry a gun. Whether or not you should is beside the point. That man didn't do anything wrong as far as I can tell.

I didn't want to listen the whole audio recording because it was too long. Anyways, as far as I know, a license to carry a handgun is typically a concealed weapons permit therefore to have it holstered in plain view in a public area is not justified because it can antagonize or threaten others. If it was at a firing range or something, then its probably different.

He has the right to bear arms and so long as he has the proper permits he hasn't done anything wrong. His rights were actually violated.
I'm Canadian not American, so I could be wrong, but I know about the right to bear arms.
