It's wise for multi-user games/online communities to have systems in place for dealing with harrassing or bullying behavior. That there be clearly written and readily available TOS, and specific infractions that can be pointed to. The player in question should certainly have recourse against behavior she finds offensive, where in a non-competitive environment one player gets their jollies entirely at the expense of another.

That said, describing this as "sexual assault" is pressing a hot button. If the woman is aware of that, she ought to be ashamed of herself. Polygons running into each other is not sexual assault, no matter how much you identify with your avatar (and if you identify with your avatar so deeply that this is causing high levels of emotional distress, you should be seeing a counselor for a problem that has nothing to do with this "assault".) If I had been a victim of actual sexual assault, I'd want her head on a stake. And if the woman in question is somehow unaware of how describing this as "sexual assault" triggers every alarm and sends the worst elements of the media scurrying, she's an IDIOT.

To be totally honest, I would be really raged, I mean, angry, fucking angry at the fact that he DARED to call this "sexual assault."

I mean, think of a real rape victim.
Think of what they go through.
Think of the physical pain, agony, mental destruction that they go through. Most of them have trouble leading a normal life after this. If they had the option to simply turn off their PS3 to make it stop, believe me, they would have, and they would be a lot happier.

It's an insult to everyone who actually has been sexually assaulted, and considering a friend of a friend committed suicide a few years ago, perceived to be because of mental trauma from a "sexual assault," I'm pretty upset that this chick's roommate is this stupid.

This type of behaviour is likely in breach of the terms of service of Sony Playstation's Home software.

However, it is not sexual harassment. There is not sufficient evidence to show that the actions were intended to be sexual in nature. While harassment from a distance is common place; threatening text messages, emails and so on the situation as described is not harassment. Also, we do not know if the user was asked to stop or if it was merely a glitch or bug.

It is an interesting suggestion, though one that should receive no credence. People could begin to make claims against multiplayer games over their (I hate this word) avatars. Imagine the amount of innuedo sex crimes that would come from an evening of tea-bagging in Halo.

We should not start accepting that a person's avatar can be the subject of harassment. However, harassment directed against a player can and does happen in virtual worlds and should not be tolerated, action should be taken based on its severity.

I particularly like that some law 'experts' claimed this could fall into harassment or even privacy laws.

While the harassment is almost impossible to prove as the nature of software is that an action seen from one user may not be the truth of what happened aka 'lag'.

What I find really interesting here is the idea of privacy. While you can play from home in private you are actually entering a virtual social space and as a result cannot have the protection from in-game events under the belief of reasonable privacy.

Unless of course your privacy was infringed on by having details hacked or stolen and being announced in the virtual space or another user was aware of who you are and relayed private information such as your address.

It is overreaction on the part of the girl, but at the least Home should have a feature where you can get the point across that you aren't welcome. Besides just putting in a harassment complaint could also bump the character away from you.

In the end though, don't blame Home for the actions of someone else. They are just being a tard, and you can either ignore them or log out for a bit. She is probably better off not going back in Home if she is going to be that supersensitive.

I don't think its necessary to make a huge complaint about it all just log off. And OMG Australia actually didn't take this and then run around with it screaming like a little kid. They actually made a decent point... wow. Also not playing it anymore is fine. It's the right thing to do, but having it be in the news is just a little to much. This is a personal issue
