The ESRB really isn't doing a very good job explaining the ratings system if this many people don't understand what constitutes an M rating.
Stop saying Oblivion, please. The console command that makes female character topless was only part of the reason why it was reclassified. Drug use (skooma), the strung up corpses that litter the planes of Oblivion, the Dark Brotherhood storyline where there was a naked and badly mutilated corpse strung up, and there's also a couple of times where you can carry body parts around in your inventory. It earned the M rating.
As for the Halo games, I agree that they probably shouldn't get an M rating. The swearing as at prime time television level, the blood and violence isn't excessive, and the gore is practically non-existent. The only reason I can think of why it might have been rated M is being able to dismember the Flood.
