I have been prevented from playing a legit game because of DRM. Fate wouldn't recognize the disc because of Securom. Sure you can eject and retry over and over again until it works but that just wears on your DVD drive and your patience. I can't prove it over the internet though so I guess I am lying, right?

EULA's don't allow Microsoft to destroy other people's property, which is why I am in this conversation. I don't care if you've modded your XBOX or not, if their update is designed to brick it, I don't think that is legal.
I feel as though I missed something. I thought you were saying that Microsoft should refund you if they ban you from Xbox Live. It is precisely because you accepted the EULA that they are allowed to do this.

Doesn't brick it, so far as I can tell. Cuts off the Xbox LIVE service from it.

That's probably the only reason they haven't faced a significant legal challenge. You're basically agreeing to 'I won't do anything illegal with this' for the most part, though some like to push the boundaries.

My guess is the first time a EULA tries to do something really crazy the whole concept will find itself in court.

And it being Microsoft has what to do with it? Sony makes the same changes from time to time, as does Nintendo.

Microsoft is taking action, even if pirates waste their lives trying to figure out how to crack it, Microsoft has still provided a deterrent for some pirates who don't want to bother with it. You don't make progress by standing still, and at least they've attempted to do something, rather than sit there, twiddling their thumbs asking "Duh, what should we do about them piraters?".

I get that, but considering how often piracy gets brought up it'd be nice if being able to discuss it candidly without encouraging illegal acts (and the definition of 'encouraging' needs to be made a little clearer) would be nice, especially when as I said before blatantly encouraging other illegal acts gets a pretty big pass.

Love the new look, love the new perks, loving the dashboard again.

Well, this is a video game and gaming news site. Considering they are probably working very closely with some members of the industry, it seems like letting their forum members 'encourage' or 'enable' piracy could conceivably be... bad.

Yeah, and I wouldn't encourage or enable piracy on the site. I would like to, however, talk about how perhaps bittorrent, or even software piracy could have a net positive effect on the industry without fear of mod wrath.
