Because, legally speaking in the US, there is no definition as to what is, and what isn't alive; and said definitions do not factor into the legality of abortion as expressed by the Supreme Court.

There's a limit to the amount of time you can wait for an abortion, so there are obviously going to be some kind of sentience factors.
As for living, as I've previously said I don't know the conditions. But they're there. You can look it up if you're that interested. But I'm not getting into this argument, as no-one can win it, seeing as it's merely a difference of opinion.

In ancient times if a tribe was unable to care for a newborn due to food pressures or it was simply beleived it would not survive it would be killed.
