They got away with it, because warcraft 1 was suppose to be a warhammer game.
But warhammer bailed at the last moment.
Blizzard has never made it a secret that they liked warhammer.

The entire Warcraft franchise actually started with Blizzard making a Warhammer fantasy RTS, presenting it to Games Workshop to get a license to Warhammer, and failing miserably. They then altered it just enough to not get sued and called it Warcraft: Orcs and Humans. So yeah, the similarities between the Warcraft games and the Warhammer franchise are entirely not coincidental.

Also the things it copied were pretty blatant too.

Zerg=Tyranids except tyranids are cooler
Protess=Eldar but orange and blue instead of white and blue
Humans=Humans(this one doesnt really count)
Zel'naga=Old ones (ancient race that created zerg/tyranids and one other race in that universe)

Also no...please dont respond with a counter-arguement you probably already had prepared saying things like "40k is ripping of warhammer fantasy ripping of Jrr tolkien ripping of mythology" because we all know that.
You do know SC was originally designed to be a Warhammer 40k game right?

Correct me if Im wrong, but has no-one mentioned Pokemon - Digimon?? When anyone says the word Digimon, the word plagiarism pops into my head. And vice-versa.

I was shocked at the bold use of footage from "Battlestar Galactica" when I watched the 1988 film "Space Mutiny". It's obvious it's ripped from somewhere else even if you've never seen BSG as the model shots look FAR better than any other prop or set in the film.

As for games I can't remember the name off the top of my head, but wasn't there a game that straight off used screenshots ripped from games like Oblivion, and such as backgrounds.

The pet monster thing is older then pokemon, only example I can think of is Monster Ranchers but I'm sure older ones exist, it's pretty much it's own genre.


And for everyone mentioning Warhammer and warcraft both are just copying a form of fantasy popularized by Lord of the Rings, same goes for the sci fi versions.

That's a good question, something that we should probably define in the thread, as the general literary definition doesn't fit. I would say the plagiarism becomes apparent when the game and/or characters are lifted directly with the intent on making money by pretending to associate with that product or appealing to an audience that might not be aware of the original work.

I would think the image is iconic enough that you wouldn't need to have it say "This is from War of the Worlds" to get the reference, and it isn't being used as the main selling point of the game. I mean this isn't "War of the Worlds: The Strategy Game", its SC2, which is known for having a large number of classic sci-fi references. And to say its trying to trick people who haven't seen War of the Worlds to thinking it did the concept first doesn't fit, as the colossi are minor parts of the game. The plot doesn't revolve around them, they don't impact the story too much, and they exist to serve only their battle purpose. You don't even see them in singleplayer until about halfway through the game.

I would ask you this, how would you create a long range siege vehicle that uses perpendicularly linear damage mechanics, is vulnerable to both air and ground attacks, and conforms to the traditional protoss art design, but without making it a tall robot? The only thing i can imagine is like a tall kite that shoots fricken lasers out of its fricken head! (oh noes i plagiarized a line from Austin Powers).

The way I would consider it plagiarism is if the plot revolved around saving earth/some planet from the colossi and the game treated itself as the spiritual sequel of War of the Worlds. As it stands they are just a reference to another piece of scifi, much like many other units in the game.

I saw that yesterday! At first I was laughing at how hard the game was ripping off Team Fortress 2 and Battlefield Heroes, but as more details rose I wanted to play it more and more.

and i think Mafia 2 is a slight ripoff off GTA:
you enter an unfamiliar area, and through the help of a contact in the city rise through the ranks of a criminal group, while driving around and open-world city, attacking civilians and shooting out with the cops.
