Yeah, he got what was coming.

Self defense is simply the act of protecting yourself and others. shooting a guy who already was mortally wounded five times is well over the line.

It's self defense when your goal is to disarm or otherwise incapacitate the aggressor so you can get away. Killing the aggressor is still murder.

Had he stopped after the first shot, nothing would have come of it. However as he proceeded to riddle the robber with bullet holes, it jumped from self defense to murder.

Actually not even that. He could have emptied his entire clip into the guy and still have been fine. It's when he went and got the second gun and shot the guy while he was on the ground that it became murder.

It's murder when you kill someone when it is not self-defense.

It was self-defense when he capped the robber in the head. Threat neutralized.

It became murder when he executed an unconscious man.

If the robbers were armed when he shot the first one then that might be understandable as an extreme case where the gun was needed.


However to actively reach for a second gun and shoot the second robber five time while he was on the floor inconcious? That is just murder plain and simple and he got the correct sentence in my opinion.


A gun is for self defence and Nothing eles what so ever.

Why didn't his lawyer plead temporary insanity?

I have literally zero experience with guns being pointed at me, nor with owning guns. But it seems to me that it's not such a stretch to say that while my heart was racing from having my life threatened like that and my adrenaline was pumping from having "won" that engagement and having successfully defended my co-workers... I have no idea what I'd do.

Break down and cry?
Victory-dance?
Catatonic state?
Kiss whomever I saw first?
Shoot the attacker five more times?

They all seem plausible to me. However outwardly calm that person seems, there's no telling what's going on in his head. Maybe the robber did twitch and he calmly and efficiently took care of the situation because he was scared shitless.

Looks like temporary insanity to me. I'm sure that having a gun stuck in your face can do that to a man. Sure, he shouldn't have shot the downed kid again. Nobody is arguing that he should have, I hope. But sentencing him to life? Two years on probation with mandatory counselling or some such seems a lot more just to me.

TL;DR Odd legal defence, imo.

The first shot was totally self-defence. After that, it was pure "you're not a threat anymore but I'm gonna shoot you a bunch anyway" murder.

Pretty clearly murder, IMO. I would have shaken my head with shame for the human race if he had been found innocent.

I agree with the sentence. It wasn't self-defense, the guy was unconscious. even one extra shot I could understand if he was just really twitchy and hopped up to high heaven on adrenaline, but 5 is clear intent to kill a helpless opponent.

Damn, that sucks. I would say it lies in self defense but he took it too far. The idiot who died absolutely got what he deserved though...

Firstly temporary insanity is a bullshit plea, and does not excuse criminal behaviour.

Secondly, a head shot is excessive. I don't think there is a need for a killshot, even if they are trying to rob you. But shooting someone on the ground is heinous and cruel, and he should go to prison.

Edit- I can't believe so many people think he deserved to die. I mean Christ, I know he's hardly an exemplary citizen, but that's just unnecessary. Robbery isn't the worst crime, and it certainly doesn't call for cold blooded murder.

Yep, do him for murder. The first instance was self-defence, and I'm not going to challenge that. Walking over to an unconscious man with a head wound and shooting him five times is murder.

I disagree on the first poin ton your second point. As my father taught me, whenever you pull the trigger, you have to be prepared that this may kill someone. Going for a killshot is clean and quick. That's your best choice.
