I honestly don't think that it possibly could have been hot enough to permanently scar anything. Have you ever had nachos? From the moment you take the cheese from the warmer, it starts to cool. I always have to eat nachos quickly cause they get cold within just a few minutes.

Even if it was that hot, it's just an unforunate accident.

I've had big cans of dog food fall onto my skull off a high shelf while in a store and I didn't sue anybody.

OT: I feel ashamed, when ever stuff like this happens. It gives us Americans bad names, I mean its the kids fault. Its just like the whole McDonalds indecent, where a guy sued for coffee being too hot.

Sorry but this is the kid's own fault.
The boy's hand caught a food tray and a cup of nacho cheese flew onto his face, burning his upper lip and other spots
If you go buy a cup of coffee from starbucks and then pour it on your face, you can't sue them for it being hot. I hope they lose this lawsuit and have to pay disney any legal fees.

Nothing is ever the reposibility of us! It's always someone else's fault! We'll sue everyone until we're proven right! We don't need to raise a child! We'll cotton wool it and protect it from life! The world's too dangerous, to the bunker!

Well, remember. If they didn't sue Disney, they *might* have to accept responsibility for their own child and who knows where that would end?

In that case the chain had been warned multiple times that the temperature of their coffee was way above safe levels. ~160 degrees as I recall. They'd been told to keep it at a lower temperature and refused. Liebeck was seriously injured and hospitalized due to burns that resulted when the coffee spilled on her. She sued requesting compensation for lost work and to cover her medical expenses. That is to say the original tort did not include a request for punitive damages. It was the jury that looked at the case and went nuts imposing a massive punitive award, which was later overthrown. In other words this is the very definition of a non-frivolous lawsuit which sounds ridiculous.

Burned themselves critical requiring a 10 day stay in the hospital and racking up 10k dollars in medical expenses because McDonnalds thought everyone wanted to drink coffee at 80C.

I'm going to trip and fall in Disney land, and hit my head on the side of the pavement. I will then sue Disney, with the cunning argument that "you should have known people would fall, why didn't you make the pavement out of rubber!".

Nachos (with cheese) are served hot - the Parents must have know that fact. It doesn't matter if they didn't know HOW hot it was, merely touching the packing is enough to inform you that the product is hot. Despite this, they gave it to their child. If they really were so concerned about the heat of the Nachos, maybe, just maybe, they should have waited for it to cool down a bit. That's what my parents did with my chips when I was very young.

If the parents were stupid enough to serve very hot nachos to their kid, and their kid injures himself due to his own clumsiness, that's hardly disney's fault. It's the parent's fault for buying him the Nachos, and placing it in front of him at the table. If they hadn't done that, the kid would be fine.

Suing Disney for this is like suing a chocolate store because your kid got fat by eating the Chocolates from that store, and you bought the Chocolates for him. If ANYONE is at fault here, it's the parents.

Now, had the parents sued over a rickety chair, THAT would have some merit. But they aren't - they are suing over the Nachos for being too hot, claiming that Disney should have KNOWN that a Child's face might end up in hot Nacho sauce and should have told parents how hot the sauce was.

You know, if you touch a hot object... I have it on good authority that the nerves under the skin of your hand will respond to the temperature and, through a rather ingenious neural system, transmit the information regarding the temperature of the object to your brain, where it will be able to process that information and come to a conclusion, rather quickly that: OW. THE OBJECT I AM HOLDING IS RATHER HOT.

You don't NEED to be told something is hot. What's next - a little label on cars saying "If this thing hits you at high speed, you might die!". Or "Caution, this lump of lead is rather heavy! If you drop it on your foot, it could hurt!".

Throw this case out - if the parents want to sue over the chair, let them - but they probably know they wouldn't get much, since falls from chairs are common and don't usually destroy a person's life (although it is possible they can). But don't let them sue over the temperature of nacho sauce. The Court system has enough on its plate already.

Read the article again, it's not that the Nachos were hot, it's that they were hot enough to cause scarring on contact.

Sad that the child's face is burned? Yes.

Disney's responsibility? No. The parents should have not left the cheese so close to the edge of the table.

Actually, I'm going to support "none of the above". Disney's fault? Yes, that should NOT have been so hot it caused scarring. Suing, though? I don't support that either.

Why make a big deal out of it? A kid got burned, so what? I got burned too, but my parents didn't sue. I made an ass out of myself, and so did the kid. If anything, there needs to be a bit better regulation on the policy's of uneven chairs/tables. And if you know your sitting down to a wonky table get one of these:
