I give the underdof the benifit of the doubt. In this case, I seriously considered the possibility that Old Navy was legitimately trying to fool customers into thinking Kim Kardashian was endorsing Old Navy. And...no. Yes, Kardashian looks very similar to the girl...but its still what this other actress friggen looks like! She can't perform in an ad because she happens to look similar to another celebrity? You can't copyright a face a person was born with. This is an asanine lawsuit

What you're talking about here is a SLAPP, and California DOES have laws against what Kardashian is doing. Granted the general use of anti-SLAPP laws is to prevent a small party from being bullied into submission by the threat of legal fees. I call absolutely 0 expertise in legalese, but hypothetically, this lawsuit could end with Kardashian being dismissed and being forced to also pay Old Navys legal fees. It's easier when it's a matter of free speech, but it could very well apply here. Lets hope it does.
