Here´s the scenario:

A 13-year old is caught looking at child porn. Nothing sick like torture or even sex, just nude girls in his age. Should he still be punished? Should the punishment be less severe?

Me? I dunno. There´s a gray and gray morality thing going on here.

Umm...nude girls his age? That, would technically still be child porn, yes. And yeah, he should be punished, and also explained to him exactly the kind of trouble he could get into simply possessing such material, regardless of intent.

Yes it's definitely a grey area. I don't think he should be punished, but he should be warned of the consequences, and punished if he does it again.

No. He should not be punished. Sure, he's going to be on every government watch list until his decayed remains have been decayed once more, and he should be warned to not go looking for 'em, but other than that? What's the harm?

Harshest thing they could do is try him as a minor and that's if they see it as a crime, which I doubt they will. Otherwise, knocking a teen under the age of 18 up would be illegal and a good portion of my school would have a criminal charge.

i don't think he should be punished from a moral point of view (i don't know what the legal situation would be, considering his age and all)
i guess it depends on if they were underage but his age or maybe older than him (which i guess would be natural for a 13 year old) or very, very underage (which i guess wouldn't)

Well, I would kinda consider this statatory rape seeing as how if two 17 YO's had sex, both consenting, would be ok with me but not with the law. So I say it wouldn't hurt to look at women a little older than you are, but he shouldn't be punished for it. Now if he did it again, or has a folder of it, that would be a little differnent.

Explaining the problem and giving him a warning is probably as far as you should go with that.

The fuck would he be punished for? That's like calling him a pedophile for have sex with girls his own age.

It should be explained that viewing porn like that is illegal and could get people in trouble, but punished is going too far for a kid's natural curiosity and ignorance of the laws. If he continues to do it, then yeah sure punish him, but other than that no.

He should be punished.

1. You are not allowed to browse nude girls under the age of 18
2.You aren't allowed to view adult content of any kind under the age of 18 (certain states may have variations on this law)

He should be punished regardless of his age, although it just means he wont have as large a sentence as someone over the age of 18 or even 16.
