I don't know anything about this beyond what you've said, but it seems like he hasn't done anything wrong. It's the people who made it that are at fault.

This thread reminds me of a black stain on the English legal system that concluded a few months ago.

An eleven-year old and ten-year old boy were convicted of attempting to rape an eight year old girl. From the details of the case, I don't think any of the three children was fully aware of their actions and their ramifications. No child should ever go on public trial, especially regarding a crime they cannot fully comprehend (this at the Old Bailey, the Central Criminal Court in London.)

I thought the law said that if two individuals are both underage it can't be considered statutory rape if they're within four years of age of eachother.

OT: No I don't think he should be punished, just given a warning. It's perfectly natural for him to be interested in naked girls his own age.

Not punished by the law, but there should be some parental sanction given.
At the same time, he needs to be made understand why this is wrong, but that curiosity about girls is not.
Pornography at best, gives a very commercialised and skewed version of human sexuality, so he also needs to be educated about this as well.

In all, he's only 13, and didn't know any better. At the same time, he's old enough to learn from this.

As seriously as an adult? Of course not.

However you need to understand that child pornography is illegal because it involves the rape and possibly imprisonment of a person that isn't even sexually mature yet. Unlike normal pornography there is absolutely no possibility of true consent. The age of the viewer makes no difference to this fact.

Pedophillia is illegal because it harms the children, not because it's "icky".

Something should be done. The fact that the pictures were of girls his own age means that he can't be categorised as a pedophile, but he is still aiding child pornography. It's a gray area, but he needs to be taught that child pornography is disgusting and should not exist. If he does not see it as wrong, he may one day become a pedophile, something which we cannot allow. As for punishment, maybe a new category for people who are themselves underage looking at child porn should be made. I think that, as a child, he might find rehabilitation successful.

This reminds me of the girl who took naked pictures of herself and got charged with possession of child porn and had to register as a sex offender. The law is very black and white, but sadly very few things are black and white, just a whole lot of grey.

No, looking at naked girls and... BOOBIESSSSS is natural, and part of growing up. I don't think anyone should be punished for this kind of things as long as its not distasteful. i.e child porn.

If they were his age, then I don't think he should be punished. He just needs to know that he can't do it again otherwise there could be more trouble, but the main purpose of the child porn laws and the age of consent laws is to protect kids from getting abused by adults... But if another kid does it, I guess it's still more of a grey area... Very complicated issue.

He should probably be punished in some way, but I hope he isn't put on a sex offender list. He doesn't need to have his life completely ruined.
