It's hardly a rip-off when it's made by the same team.
The fact that Bethesda has made both of them doesnt really matter, you can still rip off your own work, as in re-use everything but just in another setting.
It's still lazy, it's still bad and it's still a rip-off, even though they created the original idea.
All that's the same is the game engine.
The combat mechanics, graphics, atmosphere, interface, levelling system, AI, quest structure, and entire overall feel are all completely different from Oblivion.
Every dev uses the same engine for a few games.
By your logic, Left 4 Dead is a rip-off of Half Life 2, and St Pepper's was a rip-off of Revolver.
Atmosphere and Quest structure, yeah, those are different, but as a gamer who's played both Oblivion and Fallout i can tell you how much it feels like a re-hashed version of Oblivion.
the look of the NPC's and the AI are the same, the graphics are the same (only it has a different setting; steampunk instead of fantasy).

s?, i only saw 1 new thing when it came to Fallout, and that was the V.A.T.S system, which was a good inclusion (though it lowered the difficulty alot), but still, that's pretty much the only thing they changed (again, except for the setting; steamguns instead of bows for example).
Please, dont take my comments as saying that Fallout 3 was a bad game, it wasnt, it was a really good game, that im not denying, i liked it alot, but alot of that is probably because of how much i enjoyed Oblivion, as they have re-used Alot of things from it.
So no, im not saying that Fallout 3 is a bad game, its great, only its originality is lacking.
