Isn't the judge legally required to do so, rather than through things out if they happen to think they are silly?

Quite the opposite, judges in the US are allowed to throw out cases that they deem utterly trivial, and you can get a sizable penalty for filing frivolous lawsuits. I know that you get a big fine, not sure about jail time.
