You're not the only one wondering what game was the issue here, since every Wal-Mart I've every been to places the new, popular and expensive games behind glass and you're kind of expected to pay for them immediatly after asking the clerk to get them for you. I'd hate to see someone nearly kill a man over the "get them out of here, $15 or leas bin" games. It also makes you wonder what faith they have in those electronic beeping things at the door.

Maybe the laws are different there, but here in Canada you can only be accused of shoplifting if you leave the premise of the store with unpaid merchandise. If you want to hold an item in your pocket you certainly can - just make sure you pay for it before leaving!

This is basically just police stupidity and that officer needs a suspension.

Here in Canada he technically didn't shoplift anything because he hadn't left the store. If its the same down south maybe because it was a Black Friday sale the cop felt like preventing the theft instead of waiting for it to happen. Still, that was waaaaay to far. I bet that old man will have some money coming in pretty soon.

A Use-of-Force Continuum would demonstrate the level required to take down an older man who is not brandishing a weapon or causing violence to anyone currently. Using the 'crazy-times' argument is not relevant here. If they are unable to be responsible with their power, it's time to move on to a job that suits their power fantasy. Police everywhere are required to use the minimal amount of force to get the person involved to comply on a CASE BY CASE basis.

In this case...how about asking some questions?

That's a lot of blood for what MIGHT have been attempted theft.

What makes me sad is how many people on this thread are agreeing with the cop. I hope you get to experience a police state one day. You'll change your tune pretty fucking fast, jackboot licking pathetic excuses for human beings. Your acceptance of the law and your apathy towards violence makes me sick.

I'm not quite sure what to believe. Being an American, it's not surprising to see if blame goes either way. Still, the police overreacted like a child getting a toy taken away from them, so here is this:

While the OP is "grimly interested" in what game the guy was running with, I can't help but be disappointed yet unsurprised about this. Police brutality often happens whenever people "occupy" some Wall-Mart-size area by the thousands.

It says he flailing his arms around acting like a jackass. If it's true, he deserved what he got. But the video doesn't show anything prior to the police putting him down. So as it is right now, it's a case of he said/she said. I'm sure security footage could give us a pretty clear picture of what happened instead of some gawker's cell phone video, but good luck getting ahold of that...
So then you're going to be completely calm when you're being arrested without just cause, right? We don't live in a police state, yet. Last I checked, it is your right and responsibility to determine exactly why you're being arrested before you allow the police to handcuff you.
...But you're "resisting arrest" if you refuse to be unlawfully handcuffed. If you even ATTEMPT to say "hang on, why am I being handcuffed?" and make any motion with your hands away from these handcuffs, you CAN be charged with "resisting arrest." THAT'S how insane many cops are, and THAT'S how much of a police state we're in.

I bet the old guy, when accused of shoplifting, said something akin to "what the fuck are you talking about?" And the cop spun him around, the old guy squirmed as *any normal person would* and then was forced to ground and told he was "resisting arrest."

So instead of asking him what he was going to do with the games, they tackle him to the ground and bust his face open?

Im sorry, but he looks every bit of 50. Maybe older. And the police had to slam him to the ground hard enough to smash his face like a glass window?

You'll have to forgive me if i find it hard to believe 1 old man was putting up enough fight to where 2-3 officers couldnt subdue him any other way then excessive force. Couldnt mace him? Or tap him with a tazer? Have to physically BREAK his face open to get him to comply, which he may have been doing to begin with?

Im all for police using the force required to take down a perp. But not even asking him if he was going to shoplift, and then breaking his face open on the floor is NOT required.

Regardless of what the true story is, those useless asshats filming and yelling at the security guards should be ashamed for figuring they should just stand there and rant instead of actually going to help the guy that they're obviously not even concerned about.

How does one flail their arms after they've had their hands cuffed behind their back?
