A scanner darkly ... well technically, it's kind of vague but really in the end the protaginist isn't on top.
That movie ends very depressingly. The protagonist loses and everyone else is a dick.

What movies have you loved that had the bad guys come out on top?
Anyone write "Fallen" yet. Sure, Denzel gets the upper hand for a bit, but the demon uses a cat's body to get back to civilization. He wins.

A few of my personal favorites include: Lord of War, A Clockwork Orange, The Dark Knight, the Punisher, Ichi the Killer, "depends on your point of view" and Versus, because everyones a bad-guy in versus. . .
Except for the girl... she's a bad girl. but actually quite good.

Does Reservor Dogs count? I'm not quite sure who to pin the antagonist badge in that movie onto.

Also, One Flew Over the Cuckoo's Nest and Hannibal (if you consider Hannibal to be the bad guy, and not Verger). If I think of any more, I'll add them.

EDIT:
The Game beats Michael Douglas, and then he switches over and becomes part of it. I guess that counts.

My favorite for this category. Charlie comes back and shotguns the hell out of those two detectives, leaving Barton helpless and confused. Can't believe I forgot this one.

Dammit, can't believe I forgot this (just watched it last night). Cage gets conned and, though he is much happier with his new life, he loses all his fortune to his "best friend". So, I guess that means that he won in the long run.

ONE FLEW OVER THE CUCKOO'S NEST - the single greatest film (very nearly the equal of the novel) in which the villain is triumphant over the hero. Yes, the Chief escapes and McMurphy is liberated in death but injustice is still the major feeling at the end.

I assume people have already mentioned Se7en and The Wicker Man..?

Good question. Glancing at my collection: Suicide Kings, Dances with Wolves, Braveheart and Arlington Road are the first ones that haven't been said yet. At least I don't think they've been said.

Silence Of The Lambs kinda fits.

On one hand, Buffalo Bill is caught and Clarice ends up getting promoted, but Hannibal Lecter still escapes. Kind of a half-and-half

I wouldn't say Leonard in memento is a bad guy.

Teddy (Could be wrong, I forget his name) has been using him to kill people, even if you could call Leonard a bad guy, he is better than Teddy.

If you go by Oscar wins "One Flew Over the Cuckoo's Nest" is probably the greatest film were the bad guy wins.
