child pornagraphy isn't punished because it's an older individual looking at younger, it's punished because it's creation is viewed as exploitation of the child, therefore viewing it is supporting the exploitation of children. by the current justification of the law, then yes he should be punished by the full penalty.

More interesting question: if he was looking at pictures of his same age gf, and to make it more interesting, let's say they are both 15-16, is it morally wrong now? should he be punished under law now?

I don't think he needs to be punished. Even though viewing content like that is indeed illegal, but because of him being the same age, I don't see the harm. He is just naturally curious. He should be advised of the laws though.

It would be far too time consuming for a goverment to track down wether a 13 year old or a 40 year old is looking at illegal content ¬.¬ He is gonna be 16 in 3 years anyway, he best look at normal porn. Also maybe he doesnt exactly have an idea if this thing is wrong.
Because it's not wrong. Or in your opinion is looking at girls the same age as yourself wrong? And still, the law is bullshit. You can't track down everyone so you're going to make everyone who looks, regardless of age, a criminal? Again, bullshit.
Im not agreeing with the law though, im thinking about how best to avoid trouble with the law.

Although does he realise that these 13 year old girls are being abused?
I don't know. Which is why the authorities should focus more on tracking down the perpetrators rather than the one who actually watch the porn.

If he's 13 looking at 13 year old girls that's fine. If he's 13 looking at 6 year olds sit him down for a lil' chat.

Looking at 13-year-old porn?

At least he's finding out the truth, it's not as bad a 18-year-old looking at 13-year-old porn. But if the kid was looking at 18+ porn, then I wouldn't class it as a crime.

No, he shouldn't be punished. It's perfectly normal to want to see the opposite gender of your age nude.

Next time, let's punish boys playing doctor games with girls for being child molesters. Wait, stuff like that already happened [http://news.bbc.co.uk/2/hi/uk_news/england/london/8692223.stm].
That's pretty fucked up...
OT: Child pornography is pretty messed up, but he shouldn't be punished.
Who of you can honestly say that they never watched porn before turning 18?

Similar situation happened at my school, actually. Involved distribution as well, with cell phones. Kids ended up getting a week suspension from school, nothing else. Make of it what you will

....This is familiar, Penn and Teller did a BS show on this did they not?
if i recall right the young 12 year old kid was taken to court and listed down as a known pedofille simply because a girl his age sent him an explicit text, Lord christ in heaven, thats mad.

another case was when a young couple was sexting, do you think they deserved being punished for sexting?

No. He should not be punished. Sure, he's going to be on every government watch list until his decayed remains have been decayed once more, and he should be warned to not go looking for 'em, but other than that? What's the harm?
The harm is that by looking at child porn, he's creating a market for it.
I hate to be the one saying it, but there is ALWAYS going to be a market for it. One individual is going to have as much of an effect on it as one grain of sand on a mountain.

No shit, but they dont know who's watching child porn do they? It doesnt matter wether its a 13 year old or 40 year old looking it up, they will still get in trouble if they do.
So? Because you have the unknown factor in there you should just assume that everyone who watches that is a criminal? The law is flawed then and a better one should be thought up.

No. Utilize the opportunity to locate the source of the child pornography. Attempt to neutralize the threat.
Teach child that such acts will get him in incredible amounts of trouble later in life.

At the same time, everyone must be examined equally.
Actually, no. Are you going to consider a mentally handicapped person and a mentally able person equal? Are you going to consider a child equal to an adult? Of course not. You cannot judge persons equally. Each person is different.

Novskij said:
Also a new law on this would cost money, time and its phisically INFUCKINGPOSSIBLE to fucking know who the fuck is watching child porn
The assumption that was made in the OP was that it was a 13 year old child.

Novskij said:
they have no time for the little details, frankly we should be happy there are anti child pornography laws.
They should make time. Not to catch old John who was curious how a 15 year old look naked but pedo Kyle who forced that 15 year old to get naked. It's not about the ones that watch it, it's about the ones that make it and I'm fairly sure the government should make time to save children from abuse. Or is the economy more important?

Novskij said:
If people go on child porn sites, the people who abuse the poor children in the videos gain a market. So it doesnt matter if its a 13 year old or a 40 year old, because its still creating a market for those sick bastards, those bastards profit in some way, creating motivation for more child pornography, as a result kids get abused more.
Ditto.

The reason child porn is illegal in the first place is because of the abuse of the children in the videos/pictures. This is true regardless of whether the person was the same age as the children depicted or not. Therefore, he should be punished

Take also into consideration of the fact this ain't stuff that'd be out there. Type "porn" into a search engine and you'll get a gazillion results, not one of them child porn (okay, maybe not but pretty close to zero). The point is, you'd have to be actively looking for this stuff, which is what makes this kind of crime very intentional.

I think the parents should also be punished. Somebody of this age shouldn't be watching ANY porn, let alone the kind of stuff this kid is into, and the parents are partly responsible for that.

STOP RIGHT THERE, CRIMINAL SCUM.

It's a tricky one. It's wrong, but I don't think he should get jail time for it. Probably have the police come round and set him straight that he shouldn't be looking at pictures of underage girls. Maybe monitor him for a few years too, just to make sure that as he gets older, the girls hes looking at do too. Or something.

He should not be punished because at that age he doesn't fully understand everything that image says. He just see a naked body. I doubt a 13 year old has the skills to find CP but if he did type "13 year old" into google then he was just going off his preference which is natural. He doesn't yet understand how and why its illegal.

I don't see a problem with a 13 year old looking at porn, as long as the parents teach them that its just porn and not to be taken too seriously. Parents don't usually tell their kid about child porn because it doesn't seem necessary.
