child pornagraphy isn't punished because it's an older individual looking at younger, it's punished because it's creation is viewed as exploitation of the child, therefore viewing it is supporting the exploitation of children. by the current justification of the law, then yes he should be punished by the full penalty.

More interesting question: if he was looking at pictures of his same age gf, and to make it more interesting, let's say they are both 15-16, is it morally wrong now? should he be punished under law now?

I don't think he needs to be punished. Even though viewing content like that is indeed illegal, but because of him being the same age, I don't see the harm. He is just naturally curious. He should be advised of the laws though.

It would be far too time consuming for a goverment to track down wether a 13 year old or a 40 year old is looking at illegal content ¬.¬ He is gonna be 16 in 3 years anyway, he best look at normal porn. Also maybe he doesnt exactly have an idea if this thing is wrong.

Because it's not wrong. Or in your opinion is looking at girls the same age as yourself wrong? And still, the law is bullshit. You can't track down everyone so you're going to make everyone who looks, regardless of age, a criminal? Again, bullshit.

Im not agreeing with the law though, im thinking about how best to avoid trouble with the law.

No. He should not be punished. Sure, he's going to be on every government watch list until his decayed remains have been decayed once more, and he should be warned to not go looking for 'em, but other than that? What's the harm?

The harm is that by looking at child porn, he's creating a market for it.

It's not about the ones that watch it, it's about the ones that make it and I'm fairly sure the government should make time to save children from abuse. Or is the economy more important?

If people go on child porn sites, the people who abuse the poor children in the videos gain a market. So it doesnt matter if its a 13 year old or a 40 year old, because its still creating a market for those sick bastards, those bastards profit in some way, creating motivation for more child pornography, as a result kids get abused more.

Take also into consideration of the fact this ain't stuff that'd be out there. Type "porn" into a search engine and you'll get a gazillion results, not one of them child porn (okay, maybe not but pretty close to zero). The point is, you'd have to be actively looking for this stuff, which is what makes this kind of crime very intentional.

I think the parents should also be punished. Somebody of this age shouldn't be watching ANY porn, let alone the kind of stuff this kid is into, and the parents are partly responsible for that.

It's a tricky one. It's wrong, but I don't think he should get jail time for it. Probably have the police come round and set him straight that he shouldn't be looking at pictures of underage girls. Maybe monitor him for a few years too, just to make sure that as he gets older, the girls hes looking at do too. Or something.

He should not be punished because at that age he doesn't fully understand everything that image says. He just see a naked body. I doubt a 13 year old has the skills to find CP but if he did type "13 year old" into google then he was just going off his preference which is natural. He doesn't yet understand how and why its illegal.

I don't see a problem with a 13 year old looking at porn, as long as the parents teach them that its just porn and not to be taken too seriously. Parents don't usually tell their kid about child porn because it doesn't seem necessary.
