I recon it will be the riddler.
In the series of comics these films seam to be following the penguin is seen more as a go to, or a snitch, a bit like huggybear, he just owns a night club, batman goes to him for info.
The villains in this series of films dont posses powers or abilities that could never become in real life, thus Mr Freeze will never be around, nor will poison Ive as she is super human.
The most likly villain is the Riddler. He is 100% human, BUT he does have that twisted edge. He is sligtly mad, but not like the joker, the joker is grimey n psycotic, the Riddler is reserved and verry inteligent. The riddler also has the vise that he CANNOT commit a crime without leaving a riddle and so it would have good moments of his own internal struggles.
Other possibilities include Scar face, this is also a very likely villain as it to could be real and has very dark under tones.
Scarface is a hand puppet belonging to Arnold Wesker, he is born into a Mafia family and watchs his parents die, this makes him quiet and weak, he is a very nervous and weak charecter with no power, His pupper Scarface controles him, Scarface is a real brains Mafia boss who kills people and other mafia based activities. Obviously Arnold does the killings, but through his eyes he sees Scarface doing the killings and running the Mob. And so it is the split personality in his head that makes Scar face controle him, and not the otherway around.

The last possible answer is that the joker is recast and Harley Quinn is introduced.
Joker could be recast OR they could sidestep around the fact that everyone will know its NOT KL playing him, i mean you cant do a Dumbldoor actor switch with this one, people will notice, and something could happen to the Joker where his face is mangled and said new villain could help him out and rebuild his face in the good ol' pointed nose, chin and ears with big ass mouth, or he could escape and break nto chemical plant, fall in acid and get the bleached skin, red lips, perminant smile disfugurment, but thats higly unlikely, but in the brief scenes where he is the KL joker they could use CGI and low lighting. Just an idea.

Scitsos and deeply scared mental people, such as Arnold would, lol.
Who would slash their own face up? (Joker)
But its just an idea anyway, thought it fit as one of the more 'could be plausable for real world' bad guys.
But its probably gonna be Riddler, or they will drag some other villain in from the DC universe.

You can't discount Poison Ivy for that reason; In the Nolanverse, she could simply be really good with plants and chemicals. Plus, that would mesh well with the Riddler. If he's as intelligent as you say he is, he would have an empire up and running before he tried taking on Batman. Ivy would need supplies for her work, so it would be easy to set the two up together. That makes Riddler your main villain and Ivy your secondary. It also leaves it open for Scarecrow to come back again, if they feel like putting him in all three movies.

I think as long as they don't bring in Robin and have a descent villain (i.e. Two-Face, Black Mask, or a very pimped out Penguin) the film should do fine. Because I mean the first one well apart from Scarecrow (who let's face it, didn't put up much of a fight) didn't have a villain that had been in the comics (I don't think).

Now, as for Robin. Here is a much maligned character, one who divides the fans more than marmite-covered oreos. The trouble with Robin is that no-one has really tried to portray him as more than a boy-scout type hero, always helping out the Dark Knight at just the right time. Personally, I think the background to the character provides ample opportunity to create a really compelling character. Look at it this way: You've got a boy who's spent his entire life in the circus, moving from place to place, never having anywhere fixed to call his own, never having anyone other than the circus workers to call his friends. Already there's material for an interesting psychological look. Then, all of a sudden, Dick's parents are murdered in front of his eyes, in the most brutal way possible. And then, before he can even come to terms with his parents death properly, this fantastic stranger comes and offers him the skills, the training and the know-how to exact revenge on the criminals who stole his parents from him.
1) Robin: drop him and leave him, Bale already said if they bring in Robin he is gone
2) Marmite covered oreo's!?!?! thats just sick, marmite is disgusting on toast (which its meant to be on) why the hell would you then decide to put it on oreo's

Ra's al Ghul [http://en.wikipedia.org/wiki/Ra%27s_al_Ghul] was the big villain. Weren't you paying attention?

And no, we don't see Twoface land on his head, but I'm pretty sure they would have checked if he was alive at one point or another.

I'd have to guess the riddler and Postwoman. I just hope that if they do decide to use Mr. Freeze or Poison Ivy it will be better than the move Batman and Robin......oh god I think I need to lie down after remembering that film.

My thoughts:

Two-Face - Almost a certain lock.
The Riddler - I think it would be fairly easy to reimagine him so he'd fit in BB/TDK's Gotham.
Catwoman - A longshot solely due to the recent flop that starred Halle Barry (sp?).
Harley Quinn - More likely than Catwoman, but can't be anything more than a secondary villain.

Just to point out to those people saying "oh, Batman fell the same distance and he lived, so Two-Face might be alive..."- a) Batman is wearing BODY ARMOUR designed to lessen the impact from falls (he falls off a much higher building saving Rachel), and b) he hangs on to the beam which kills his momentum before he drops, whereas Harvey is thrown off. I don't really see how Dent could be brought back, seems fairly certain he's dead.

Actually, it's that Batman threw a mob boss down from about the same height, and it only broke his legs.

Obviously, the Joker must come back for the third installment (the dance is not yet done)...and yes, I believe whoever dons the mantle...err, face-paint...and attempts to play him in the third film will be unfairly compared and scrutinized. But to build the plot line with the Joker to the breaking point as the film did and leave him completely unresolved would be the greater crime. Yet everyone castrated Maggie Gyllenhall for taking up the role of Rachael after Katie Holmes, what is going to happen with whoever they get to play Jokes?

It is catwomen then, i agree it'll be riddler as the main villian the two just go together,
it'll be fun to see a darker side of the riddler.
