This post doesn't matter. I got mixed up between a book and a film.

Was convinced someone had turned I Have No Mouth and I Must Scream into a film. Turns out I'm wrong.

Swordfish.

Travolta gets away with the money AND Halle Berry.
Damnit you got it before me!

Ha, well to be fair someone got it before ME, I just didn't notice in time.
Hold on. Even though he kidnaps the main character and his daughter, I think you've still meant to root for him as the 'doing what's necessary' guy...although it's a bad movie and this may not come across...

He's still the main antagonist (even though that's not synonymous with "bad guy" in all cases). He's getting in Hugh Jackman's way.

And you can root for the bad guy and still have him be a bad guy. It's fun!

I'd say the villain didn't win in the Usual Suspects. He went through all that trouble to make sure a witness didn't identify him. Instead he ended up giving the police his mugshot. True, he managed to escape, but he still failed his original goal. Once his photo is plastered over every newspaper, it's going to be harder to due business.
True, but the extent of his criminal empire combined with the fact that no one TRULY knows if Kaiser Soze exists let alone trust the police to actually get a picture of the guy leads me to believe that business would remain fruitful regardless.
The know he exists now and have his photo and a police sketch. Kaiser's number one advantage just went out the window. Now he has to go into hiding to avoid being assassinated by a rival mobster or arrested by the police.
They don't REALLY know if Kaiser Soze exists or just a myth that Verbal Kint used to his advantage. Remember...Kaiser Soze's name wasn't mentioned until the agent asked him who he was. Every other name used during Verbal's story was made up, why not use an old Hungarian super villian to mess with the cops too?

I admit that there are tiny clues that prove he does exist, but the point is that we really aren't 100% sure.

The main one that springs to mind is Funny Games. There is just nothing given to the audience in the way of hope or relief throughout that entire film.
Dude, that is one messed up film (I saw the original German one not the remake) and I don't think I want to go through that experience again any time soon!

Swordfish also a good response, I had totally forgot about that.

Only other one that has come to mind that hasn't been mentioned was Blair Witch Project.

"Brazil". Although I don't want to spoil it for anyone who hasn't yet seen it. It's a fantastic film, extraordinarily dystopian movie from Terry Gilliam. Think Monty Python meets 1984, gets drunk and they go for a curry with Blade Runner.
That has to be the greatest summary of Brazil I think I've ever read! Thanks for that; you just made my night.....

The Ninth Gate.
The Descent. Coincidentally also has the 'Brazil' ending but way more downbeat.
Angel Heart.

Keyser Soze does win in the Usual Suspects. Verbal tells the Kujan that once he (Verbal) has been removed, Soze is going to disappear: "You think you can catch Keyser Soze? You think a guy like that comes this close to getting caught and sticks his neck out? If he comes up for anything it'll be to get rid of me. After that, my guess is you'll never hear from him again."
And then he does exactly what he says. he even leaves his enemy Kujan standing there helpless; wins don't get bigger than that.

Harakiri

A truly incredible film if you understand Japanese culture/history. The bad guy "wins" in a way, but it was more because the tale was set during an important time of transition in Japanese history and as such is more of a tragic story about futility.
